Creating estate planning documents is wise move in New Year

Some individuals in Florida may be entering 2019 with New Year's resolutions. One resolution that would be good to add to the mix is creating estate planning documents. Here is a rundown on a couple of documents that are important to create sooner rather than later this year.

First, it may be helpful to create an existing health care proxy. This document allows a person to name somebody to make medical decisions for him or her in the event of incapacitation. For instance, perhaps the person has suffered a medical emergency or is a car crash victim. It is critical for people to make their desires known to their appointed agents, which include their preferences for medical care if they end up suffering terminal illnesses.

Second, it may be beneficial to create a power of attorney. This document appoints someone to handle an incapacitated person's assets and finances. For instance, the appointed agent can do banking, buy and sell real estate, or file taxes on the incapacitated individual's behalf.

Finally, it is a good idea to create a last will and testament. This document spells out who will get certain assets when the asset owner dies, as well as who will gain custody of the individual's minor children. Spelling this out in a will can help to prevent conflicts among family members following the individual's death in Florida.
